Terms
Terms and conditions
The agreements for domain names, e-mail, hosting and our other services.
Last updated: 3 November 2026
These terms are a translation of the Dutch version. In case of differences, the Dutch text prevails.
1. Definitions
- 123 IT: 123-NL B.V., Hurksestraat 60, 5652 AL Eindhoven, KVK 88560686, trading under the name 123 IT.
- Client: any natural person or legal entity that enters into an agreement with 123 IT.
- Services: registration and management of domain names, business e-mail, website hosting, maintenance and the other IT services of 123 IT.
- Registry: the organisation that manages an extension, such as SIDN for .nl.
2. Applicability
- These terms apply to all quotes, orders and agreements of 123 IT.
- For domain names, the rules of the relevant registry also apply, such as SIDN’s General Terms and Conditions for .nl Registrants. The client accepts these rules upon registration.
- Deviations only apply if they have been agreed in writing.
3. Formation of the agreement
- The agreement is formed as soon as 123 IT confirms an order by e-mail or in writing.
- 123 IT may refuse an order without giving reasons.
4. Domain names
- The domain name is registered in the client’s name. The client is and remains the holder.
- 123 IT does not guarantee that a requested domain name is available or will be assigned. The registration is only final after confirmation by the registry.
- The client is responsible for the choice and use of the domain name and guarantees that it does not infringe the rights of others, such as trademark rights.
- The client provides correct and complete details and reports changes immediately.
- When leaving, the client receives the transfer code (auth code) from 123 IT free of charge, provided all invoices have been paid.
5. Term, renewal and cancellation
- Services are entered into for one year and then tacitly renewed for one year each time.
- Cancellation is possible up to one month before the end of the term, by e-mail to info@123-it.nl.
- If the client is a consumer, they may cancel at any time after the first term with one month’s notice.
- After cancellation or in case of non-payment, the domain name expires at the end of the term. 123 IT is not liable for the loss of a domain name that was not paid on time.
6. Prices and payment
- Prices are shown on the website and are excluding VAT, unless stated otherwise.
- Services are invoiced annually in advance. The payment term is 14 days.
- If registries or suppliers increase their rates, 123 IT may pass these on. This will be announced at least one month in advance. The client may then cancel as of the date the increase takes effect.
- In case of late payment, 123 IT may suspend the service after a reminder. Statutory interest and reasonable collection costs are payable by the client.
- An introductory price for the first year only applies to the first registration period.
- The free first year of a .nl domain name only applies if the client also takes business e-mail or website hosting for at least one year. If that service is cancelled within the first year, the regular first-year rate of the domain name will still be charged.
7. Hosting and e-mail
- 123 IT aims for the highest possible availability, but does not guarantee uninterrupted operation.
- 123 IT makes daily backups of the websites it hosts. The client remains responsible for keeping its own copy of important data.
- The services may not be used for spam, illegal content, infringement of the rights of others, malware or activities that disrupt the systems or other clients. In case of violation, 123 IT may block the service immediately.
- Use must be reasonable (fair use). In case of exceptional use, 123 IT will first consult the client about a suitable package.
8. Liability
- The liability of 123 IT is limited to the amount the client paid for the relevant service in the twelve months before the damage.
- 123 IT is not liable for indirect damage, such as lost profits or lost data, nor for outages at registries or other third parties.
- These limitations do not apply in case of intent or deliberate recklessness on the part of 123 IT.
9. Privacy
- 123 IT processes personal data in accordance with the GDPR and the privacy statement on this website.
- Insofar as 123 IT processes personal data on behalf of the client, for example for e-mail or hosting, a data processing agreement applies. It is available on request.
10. Force majeure
- In case of force majeure, such as outages at suppliers or registries, power failures or cyberattacks, the obligations of 123 IT are suspended for as long as the force majeure lasts.
11. Changes
- 123 IT may change these terms. Changes will be announced at least one month in advance.
12. Applicable law
- Dutch law applies to all agreements. Disputes will be submitted to the competent court in the district of Oost-Brabant, unless the law provides otherwise.
